Terms of Service — Deal Curators

By creating an account or using dealcurators.com and related services (the "Service"), you agree to these Terms. If you don't agree, don't use the Service.

1. What the Service does

Deal Curators discovers curated retail deals and provides them to you as affiliate links. Depending on your plan, links are tagged either with our affiliate identifiers (for deals you shop yourself) or with affiliate identifiers you provide (for links you share). See Section 4. We are a tool for surfacing and tagging deals; we do not sell the underlying products, set their prices, fulfill orders, or process retail purchases — the retailers do.

2. Accounts and eligibility

You must be at least 18 years old and able to form a binding contract. Authentication is handled by our provider (Clerk); you're responsible for the security of your login and for all activity under your account. Provide accurate information and keep it current.

3. Plans, billing, and cancellation

The Service offers a Free plan and paid plans (currently Starter and Pro). Paid plans are billed on a recurring subscription through our payment processor (Stripe) at the price shown at checkout, and renew automatically until cancelled. By subscribing you authorize recurring charges to your payment method.

You can cancel anytime through the billing portal. Cancellation stops future renewals; you keep paid access through the end of the current billing period, after which the account reverts to the Free plan. Except where required by law, payments are non-refundable and we don't provide prorated refunds for partial periods. We may change plan features or pricing prospectively with reasonable notice; changes don't affect the period you've already paid for.

4. Affiliate links and commissions

Deal Curators surfaces retail deals as affiliate links. On the Free plan, the deal links we provide may be tagged with Deal Curators' own affiliate identifiers (currently Walmart via Impact and Woot via CJ Affiliate), in which case Deal Curators receives any resulting affiliate commission. The Free plan is provided for you to discover and shop deals for yourself; it does not grant you a license to forward, redistribute, or otherwise re-share Deal Curators' tagged links. On paid plans (Starter and Pro), deal links are tagged with the affiliate identifiers you provide, for you to share, and you receive the commission — subject to each retailer's and network's own terms and your compliance with them.

Whenever you share an affiliate link, you are solely responsible for making any disclosures required by law (for example, the U.S. Federal Trade Commission's endorsement guidelines) to the people who see or click your links, and for complying with the terms of every retailer and affiliate network whose links you use.

5. Your responsibilities

You agree that any affiliate identifiers you provide are yours and are used in good standing with the relevant networks; that you will comply with all applicable laws and the terms of the retailers and networks (Walmart/Impact, Woot/CJ, eBay Partner Network, Amazon Associates, and others); and that you will not use the Service to engage in fraud, spam, cookie-stuffing, misrepresentation, or any activity that violates a network's rules. You are responsible for your own tax obligations on commissions you earn.

6. Acceptable use

Don't misuse the Service: no scraping or automated bulk extraction of our data, no reverse engineering, no reselling or redistributing the Service or its deal data except as expressly permitted, no attempts to breach security or access other users' data, and nothing unlawful. We may suspend or terminate accounts that violate these Terms.

7. Third-party retailers, networks, and services

The Service depends on and links to third parties (retailers such as Walmart, Woot, eBay, and Amazon; affiliate networks such as Impact and CJ Affiliate; and infrastructure providers). We don't control them and aren't responsible for their content, availability, pricing, product accuracy, order fulfillment, or their terms and policies, which apply to you separately. Deal availability, prices, and commission rates change constantly and may be inaccurate or expire without notice.

8. Intellectual property

The Service, including our software, design, and curated presentation of deals, is owned by Deal Curators and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. Retailer and network names and marks belong to their respective owners.

9. AI-generated content (Pro plan)

The Pro plan includes an AI content generator that drafts suggested captions, product descriptions, and other promotional copy. This output is produced by automated systems (which may rely on third-party AI providers that process the prompts and deal data involved) and is offered only as a drafting aid. It may be inaccurate, incomplete, generic, or unsuitable, and we make no warranty as to its accuracy, originality, or fitness for any purpose. Before you use or publish any AI-generated content, you are responsible for reviewing and editing it and for ensuring it is truthful and compliant — including the U.S. FTC's endorsement/disclosure guidelines, the applicable retailers' and networks' terms and trademark rules (for example, restrictions on using a retailer's marks alongside phrases like "% off," "sale," or "coupon"), and all applicable law. As between you and us, you are responsible for the content you choose to publish, and you should not rely on AI output as legal, financial, tax, or other professional advice. We may impose usage limits on, change, or discontinue the feature.

10. Copyright and DMCA

The Service surfaces product information — including titles, descriptions, images, and prices — obtained from retailers and affiliate networks through their official APIs and approved feeds. That material belongs to the retailers, brands, or their licensors and is displayed to identify deals, not to claim ownership. We respect intellectual-property rights and expect users to do the same.

If you believe material on the Service infringes a copyright you own or control, send a notice under the U.S. Digital Millennium Copyright Act (DMCA) to our designated agent, including: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and enough information to locate it; (d) your name, address, phone, and email; (e) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf. We will respond as the DMCA requires, may remove or disable access to the material, and may terminate repeat infringers.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that deals are accurate, current, available, or that using them will result in any commission or income.

12. Limitation of liability

To the fullest extent permitted by law, Deal Curators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or commissions, arising from or related to the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve (12) months before the claim or USD $100.

13. Indemnification

You agree to indemnify and hold Deal Curators harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your affiliate activity, your content, or your violation of these Terms or any third-party rights or network terms.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive (including 4–13) survive termination.

15. Changes to these Terms

We may update these Terms; we'll post the updated version with a new effective date and, for material changes, provide reasonable notice. Continued use after changes take effect means you accept them.

16. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws rules.

Before filing any claim, you agree to first try to resolve the dispute informally by contacting us at info@dealcurators.com and giving us thirty (30) days to work it out in good faith. If we can't resolve it that way, you and Deal Curators agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Utah, and you consent to the personal jurisdiction of those courts. Nothing here prevents either party from seeking injunctive relief for intellectual-property or unauthorized-access claims.
